Jessica Levinson, LMU Loyola Law School professor, explains the limitations of the First Amendment in cases involving private employers and their employees. “The question of whether or not a private employer like ABC can fire a private employee like Jimmy Kimmel is not a First Amendment question.” She adds, “we only get to a First Amendment question if ABC–that private employer–is coerced by the federal government.”
