Justin Levitt, professor at LMU Loyola Law School, commented on a provision in the SAVE Act about states’ authority to remove individuals from the list of eligible voters. “[I]t’s not obvious that all of the ways people will be removed from the rolls will be subject by the SAVE Act to notice and an opportunity to respond…I’d think there are constitutional protections that would kick in, but they’re not explicit in the statute, and that’d take someone litigating,” Levitt said.
